Terms and Conditions

These Terms and Conditions govern the use of the KontBook website, KontBook Pro application, and related services. By creating an account or using KontBook, you agree to these Terms and our Privacy Policy.

KontBook provides business-management software for managing customers, products, orders, deliveries, inventory, payments, expenses, invoices, ledgers, staff, routes, reports, and related business records.

KontBook is a technology platform. Unless expressly stated otherwise, KontBook is not a seller, distributor, delivery provider, payment processor, accountant, tax adviser, or party to transactions between users and their customers, suppliers, staff, or other third parties.

Eligibility and Accounts

You must be at least 18 years old and legally capable of accepting these Terms. If you use KontBook for a business or organisation, you confirm that you are authorised to accept these Terms on its behalf.

You must provide accurate information, protect your login credentials and devices, appropriately manage team-member access, and notify KontBook if you suspect unauthorised account activity.

Business Data

You retain ownership of information submitted through your account. You permit KontBook to process, store, transmit, back up, and display that information as necessary to provide, secure, maintain, and improve the Services.

You are responsible for ensuring that you have permission to store information relating to customers, employees, suppliers, and other persons. You are also responsible for the accuracy and legality of information entered through your account.

Invoices, GST and Reports

Invoices, bills, ledgers, GST reports, calculations, and exports are generated from information provided by users. These features are business-management tools and do not constitute accounting, legal, financial, or tax advice.

You must review generated documents and ensure compliance with applicable tax, invoicing, accounting, and record-keeping requirements. KontBook is not responsible for errors or penalties caused by inaccurate or incomplete information entered by users.

Acceptable Use

You must not use KontBook for unlawful or fraudulent activities, upload malicious software, attempt unauthorised access, impersonate another person, violate privacy or intellectual-property rights, bypass security controls, or commercially resell the Services without written permission.

KontBook may investigate suspected misuse and restrict or suspend access where reasonably necessary.

Team Members

Business owners and administrators are responsible for assigning suitable roles, reviewing permissions, removing access when no longer required, and ensuring that their team members comply with these Terms.

Subscriptions and Payments

KontBook may provide free, trial, or paid plans. Pricing, applicable taxes, billing periods, and included features will be communicated before a paid plan is activated.

Applicable fees must be paid when due. Access to paid features may be restricted if payment is unsuccessful or overdue. Fees are non-refundable except where required by law or expressly stated in an applicable offer.

Third-Party Services

KontBook may connect with services such as WhatsApp, email applications, app stores, maps, payment providers, or device features. Third-party services are governed by their own terms and privacy policies. KontBook is not responsible for their availability, security, or conduct.

Intellectual Property

The KontBook name, logo, software, designs, interfaces, text, graphics, and other KontBook-provided content are owned by or licensed to KontBook.

You receive a limited, non-exclusive, non-transferable, and revocable right to use the Services for your internal business purposes. No ownership rights are transferred to you.

Availability and Updates

We aim to provide reliable Services, but we cannot guarantee uninterrupted, error-free, or continuously available access. Maintenance, updates, internet problems, third-party failures, security incidents, or circumstances outside our reasonable control may affect availability.

Some application updates may be required to continue using the Services.

Data Backup

KontBook takes reasonable measures to protect and maintain information handled through the Services. You should nevertheless retain copies of important business, financial, tax, and legal records and periodically use available export features.

Suspension and Termination

KontBook may suspend or terminate access for material violations of these Terms, unpaid fees, unlawful use, security risks, legal requirements, or discontinuation of the Services.

Where reasonably possible, we will provide notice and an opportunity to resolve the issue unless immediate action is necessary.

Account Deletion

You may request account deletion through any deletion facility provided by KontBook or by emailing support.kontbook@gmail.com.

We may verify your identity and authority before processing the request. Personal information associated with the account will be deleted or anonymised unless retention is reasonably required for legal compliance, accounting obligations, security, fraud prevention, or dispute resolution.

Deleting a team member’s access may not delete business records owned by the relevant business account.

Disclaimer

To the extent permitted by law, KontBook is provided on an “as is” and “as available” basis. We do not guarantee that the Services will satisfy every business requirement or prevent business losses, disputes, fraud, or compliance issues.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

Limitation of Liability

To the maximum extent permitted by law, KontBook will not be responsible for indirect, incidental, special, consequential, or punitive losses, including loss of profits, revenue, goodwill, opportunity, or data.

KontBook is not responsible for losses caused by inaccurate user-entered information, unauthorised account activity, decisions made without reviewing generated records, third-party transactions, compromised user devices, or events outside our reasonable control.

Nothing in these Terms limits liability for fraud, wilful misconduct, or liability that cannot legally be limited.

Privacy

Personal information is handled according to the KontBook Privacy Policy and applicable law.

Changes to These Terms

KontBook may update these Terms to reflect changes in the Services, laws, security practices, or business operations. Material changes will be communicated through an appropriate channel, and the effective date will be updated.

Governing Law

These Terms are governed by the laws of India. Both parties should first attempt to resolve disputes in good faith.

Subject to applicable consumer-protection rights, courts having jurisdiction in Bengaluru, Karnataka, India will have jurisdiction over disputes relating to the Services.
